1. About this Privacy Policy

Reality Fishing is committed to protecting the privacy of the people who use our website, membership platform, services and promotions.

This Privacy Policy explains how Reality Fishing collects, holds, uses and discloses personal information and how you can access, correct or raise concerns about the personal information we hold about you.

For the purposes of this Privacy Policy, “Reality Fishing”, “Reality Club”, “we”, “us” and “our” refer to Reality Fishing, ABN 83 696 402 963, trading as Reality Fishing.

This Privacy Policy applies when you interact with Reality Fishing, including when you visit our website, create an account, become a member, enter a giveaway or promotion, redeem a member benefit or discount, make a purchase, make or receive a referral, communicate with us, interact with our social media accounts or otherwise use our services.

We handle personal information in accordance with applicable Australian privacy laws, including the Privacy Act 1988 (Cth) and the Australian Privacy Principles where they apply to us.

2. What is personal information?

Personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable.

Depending on how you interact with Reality Fishing, the personal information we collect may include information that directly identifies you as well as information which, when combined with other information, may reasonably identify you.

3. Personal information we may collect

The personal information we collect depends on how you interact with Reality Fishing.

We may collect your name, date of birth or age information, residential or postal address, postcode, email address, telephone number, username, account details, membership tier, membership status and communication preferences.

Where you purchase a membership or product, we may collect transaction information including products or services purchased, membership payments, transaction identifiers, payment status, billing details, refunds, discounts and other transaction records.

Payments may be processed by third-party payment processors. Reality Fishing generally does not receive or store your complete payment card number, security code or complete payment credentials. We may receive limited payment information such as payment status, transaction references and partial card identifiers from our payment provider.

We may collect information relating to your Reality Fishing membership, including your membership tier, benefits available to you, benefits you have redeemed, discount codes issued or used, giveaway entries, referral credits, membership history, account activity and other information necessary to operate your membership.

Where you participate in a giveaway, competition or promotion, we may collect information necessary to administer that promotion, including your identity, contact information, eligibility information, entry information, membership status, referral entries, prize preferences and information required to verify or deliver a prize.

If you win a giveaway or promotion, we may also collect information reasonably required to confirm your eligibility, verify your identity, contact you, arrange delivery or fulfilment of the prize and comply with applicable competition or trade promotion requirements.

Where you participate in Reality Fishing’s referral program, we may collect information connecting a referral code or link with the referring member and the referred account, together with information about whether the referral qualified for a membership benefit or additional giveaway entries.

We may collect communications you send to us, including enquiries, support requests, complaints, feedback, survey responses and correspondence through email, our website, telephone, messaging services or social media.

Where you voluntarily provide photographs, videos, reviews, testimonials, competition submissions or other content to Reality Fishing, we may collect and hold that content together with information relating to its submission.

We may also collect technical and usage information when you interact with our website or online services. This may include your IP address, device type, operating system, browser type, referring website, pages viewed, links selected, session information, approximate location derived from your IP address, date and time information, website activity and similar technical information.

We do not generally seek to collect sensitive information. If sensitive information is reasonably necessary for a particular activity, we will handle that information in accordance with applicable privacy law and obtain consent where required.

4. How we collect personal information

We usually collect personal information directly from you.

This may occur when you create or update an account, purchase or renew a membership, purchase merchandise, enter a giveaway, use a referral code, redeem a member benefit, subscribe to communications, complete a form, contact us, respond to a survey, submit content or interact with our website or social media accounts.

We may also collect information automatically through our website and associated technologies, including cookies, server logs, analytics technologies, tracking pixels and similar technologies where these are enabled.

In some circumstances we may receive information from third parties. These may include payment processors, website and membership service providers, referral partners, prize suppliers, commercial partners, marketing platforms, analytics providers, social media platforms, fraud or security providers, and other service providers involved in delivering Reality Fishing services.

If another person provides information about you to Reality Fishing, that person should only provide information they are authorised to provide.

Where reasonable and practicable, we will collect personal information directly from you.

5. Why we collect and use personal information

We collect, hold and use personal information where reasonably necessary to operate Reality Fishing and provide our services.

This includes establishing and managing accounts; processing memberships, renewals, cancellations, transactions and refunds; administering membership tiers and benefits; calculating and allocating giveaway entries; operating referral programs; issuing and validating member discount codes; determining eligibility for promotions; administering and drawing giveaways; contacting winners; arranging prize fulfilment; responding to enquiries and support requests; improving our website and services; preventing fraud and misuse; maintaining security; performing business administration; maintaining records; complying with legal obligations; and resolving disputes.

We may also use information to understand how members use Reality Fishing, assess membership and marketing performance, develop new benefits and features, improve our commercial partnerships and produce aggregated or de-identified statistics.

Where information has been de-identified so that an individual is no longer reasonably identifiable, we may use or disclose that information for analytics, business planning, reporting and other legitimate business purposes.

6. Memberships and member profiles

Reality Fishing may maintain a member profile associated with your account.

Your profile may include your membership tier, membership status, benefits, discounts, giveaway entries, referrals, transaction history, engagement history, account activity and communication preferences.

We use this information to provide the benefits attached to your membership, maintain accurate giveaway entries, prevent misuse of benefits and understand how members interact with Reality Fishing.

Some membership benefits may be provided by third-party businesses. Where this occurs, information may be shared with the relevant provider where reasonably necessary to verify your eligibility or provide the benefit, as described further below.

7. Giveaways, competitions and promotions

Reality Fishing may conduct giveaways, competitions and other promotions.

Each promotion may also have specific terms and conditions explaining its eligibility requirements, entry methods, prize conditions and other rules. Those terms should be read together with this Privacy Policy.

We may use personal information to administer a promotion, verify entries, identify and contact winners, confirm eligibility, prevent fraudulent entries, arrange prize delivery and meet legal or regulatory obligations.

Where required by applicable laws, permit conditions or the terms of a promotion, Reality Fishing may publish limited information about a winner. This may include details such as the winner’s name or initial, surname, suburb, state or postcode. We will limit published information to what is reasonably necessary or legally required.

Where a prize is provided by another organisation, we may provide that organisation with the information reasonably necessary to deliver or administer the prize. We do not give a prize provider unrestricted access to our member database merely because it supplies a prize.

8. Referrals

Reality Fishing may operate referral programs under which members receive additional benefits or giveaway entries when another person joins or completes a qualifying action using their referral link or code.

We may record the connection between the referring member and the referred account to determine whether referral conditions have been satisfied and to allocate the appropriate benefit.

We will not disclose unnecessary personal information about a referred member to the person who referred them.

9. Partner offers and benefits

Reality Fishing works with commercial partners that may provide discounts, offers, experiences, giveaways, products or other member benefits.

Where a benefit can be delivered without providing your personal information to a partner, such as through a general or member-specific discount code, we may use that method.

Where information needs to be shared with a partner to verify eligibility, complete a booking, fulfil a prize or provide a benefit, we may disclose the minimum information reasonably necessary for that purpose.

This may include disclosures to organisations such as Big Cat Reality and other accommodation, tourism, fishing, marine, retail, training or prize partners where you have chosen to use a benefit or won a prize associated with that organisation.

Reality Fishing does not sell its member database or members’ personal contact information to commercial partners for those partners’ independent marketing.

We will only disclose personal information to a commercial partner for its own direct marketing where you have provided appropriate consent or where the disclosure is otherwise permitted by law and has been made clear to you.

10. Who we may disclose information to

We may disclose personal information to organisations involved in operating Reality Fishing and providing our services.

These may include payment processors; website hosting providers; cloud storage providers; ecommerce and membership-platform providers; email and SMS providers; customer communication systems; analytics providers; advertising platforms; IT and cybersecurity providers; accountants, lawyers and professional advisers; insurers; fulfilment and delivery providers; prize providers; commercial partners where necessary to provide a benefit; and government agencies, regulators, courts or law-enforcement bodies where required or authorised by law.

Our website may use third-party technology and services, which may include payment platforms such as Stripe, ecommerce or membership technology such as WooCommerce and associated website plugins, analytics platforms, social media services and other software providers. The particular services we use may change over time.

We require our service providers to handle information appropriately having regard to the services they provide and applicable legal requirements.

We may also disclose information where reasonably necessary to establish, exercise or defend legal claims; investigate suspected fraud or unlawful activity; protect Reality Fishing, its members or other persons; or respond to a lawful request.

If Reality Fishing undergoes a business sale, merger, restructure, financing transaction or transfer of assets, personal information may be disclosed to professional advisers, prospective purchasers or other parties involved in the transaction, subject to appropriate confidentiality and legal requirements.

11. We do not sell your personal information

Reality Fishing does not sell personal information or member contact databases to third parties.

Commercial partners do not receive automatic access to Reality Fishing’s member database simply because they provide a member offer, sponsorship, promotion or prize.

We may provide partners with aggregated or de-identified information about membership activity, campaign performance, benefit redemptions or similar business information where that information does not reasonably identify individual members.

12. Direct marketing

With your consent, where reasonably expected or otherwise permitted by law, Reality Fishing may send you information about memberships, member benefits, partner offers, giveaways, promotions, products, events and other Reality Fishing news.

Marketing communications may be delivered by email, SMS, social media, online advertising or other electronic communication channels.

Where required, we will obtain appropriate consent before sending commercial electronic messages and will provide a method for you to unsubscribe.

You can unsubscribe from marketing emails using the unsubscribe function contained in the message or contact us directly. Where SMS marketing is used, the message will provide an appropriate method of opting out.

We will process unsubscribe requests in accordance with applicable law, generally within five working days for commercial electronic messages.

Unsubscribing from marketing does not necessarily prevent us from contacting you about non-marketing matters relating to your account or transactions, such as membership administration, receipts, security notifications, important service updates, giveaway administration or prize fulfilment.

We do not provide your personal information to partners so they can send their own marketing communications unless appropriate consent has been obtained or this is otherwise permitted by law.

13. Cookies, analytics and tracking technologies

Reality Fishing may use cookies and similar technologies to operate and secure our website, remember preferences, maintain sessions, understand website usage, measure campaign performance and improve our services.

Where enabled, we may also use third-party analytics or advertising technologies, including pixels or similar tracking technologies.

These technologies may collect information such as your IP address, device information, browser information, website activity, pages viewed, referring URLs, transactions or conversion events and interactions with advertising.

Some third-party services may be able to combine information collected from the Reality Fishing website with information they already hold about you.

Where appropriate, Reality Fishing will provide information or controls relating to non-essential analytics or advertising technologies. You may also be able to manage cookies through your browser or device settings. Disabling certain cookies may affect the functionality of the website.

We seek to configure tracking technologies so that they do not intentionally transmit sensitive information and to limit information collection to what is reasonably necessary for the relevant purpose.

14. Social media

Reality Fishing operates social media accounts and may use social media platforms to communicate with members and the broader community.

If you communicate with us through a social media platform, the platform may collect and handle information independently under its own privacy terms.

Information that you make publicly available through social media may be visible to Reality Fishing and other users.

Where we use social media advertising or measurement tools, information may be processed by the relevant platform in accordance with its own privacy practices.

15. Third-party websites

Reality Fishing may provide links to partner websites, booking systems, stores, social media platforms and other third-party services.

Once you leave a Reality Fishing-controlled service, the third party’s privacy policy and terms generally apply to the information it collects.

Reality Fishing is not responsible for the privacy practices of independent third-party websites or services. You should review their privacy information before providing personal information.

16. Storage and security of personal information

Personal information may be stored electronically in Reality Fishing systems and in systems operated by service providers acting on our behalf.

We take reasonable technical and organisational steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure.

Depending on the circumstances, these measures may include access controls, authentication measures, security monitoring, encryption where appropriate, backups, software updates, restricted administrative access and internal processes for handling personal information.

No internet transmission, cloud service or electronic storage system can be guaranteed to be completely secure. Users should also take reasonable steps to protect their accounts, including keeping passwords confidential and notifying us if they suspect unauthorised account access.

17. Overseas storage and disclosure

Some of Reality Fishing’s technology and service providers may operate or store information outside Australia.

As a result, personal information may be disclosed to or processed by recipients located overseas.

The countries involved depend on the service providers Reality Fishing uses from time to time and may include Australia, the United States or any other countries our services are located in.

Where applicable, we take reasonable steps in relation to overseas disclosures as required by Australian privacy law.

Third-party service providers may also process information in additional locations in accordance with their own infrastructure and privacy arrangements.

18. Data retention

Reality Fishing retains personal information for as long as reasonably necessary for the purposes for which it was collected and for legitimate business, legal, taxation, accounting, fraud prevention, dispute resolution and compliance purposes.

Different categories of information may be retained for different periods.

For example, certain transaction, competition, consent and accounting records may need to be retained after a membership ends.

Where personal information is no longer required for a permitted purpose and we are not required by law or another legitimate reason to retain it, we will take reasonable steps to destroy or de-identify it.

Backups and archived systems may retain information for an additional period until it is securely overwritten or deleted in accordance with normal system processes.

19. Data breaches

Reality Fishing maintains processes for responding to suspected data breaches.

If a breach occurs, we will assess the circumstances and take reasonable steps to contain and address the incident.

Where the Notifiable Data Breaches scheme or another applicable law requires notification, we will notify affected individuals and the Office of the Australian Information Commissioner or other relevant regulator as required.

20. Accuracy of information

We take reasonable steps to ensure personal information we hold is accurate, up to date, complete, relevant and not misleading, having regard to the purpose for which it is held.

Members are encouraged to keep their account information current.

You can update information available through your account or contact us if information we hold about you is incorrect.

21. Access to your personal information

You may request access to personal information Reality Fishing holds about you.

To make a request, contact us using the details in the Contact Us section below.

We may need to verify your identity before providing access to protect your information from unauthorised disclosure.

In some circumstances, applicable law may permit or require us to refuse access to particular information. If that occurs, we will provide an explanation where required.

We will respond to access requests within a reasonable period.

22. Correction of personal information

If you believe personal information we hold about you is inaccurate, out of date, incomplete, irrelevant or misleading, you may ask us to correct it.

We will take reasonable steps to assess and respond to the request. Where appropriate, you may also be able to correct information directly through your Reality Fishing account.

23. Requests to delete information

You may contact Reality Fishing to request deletion of personal information associated with your account.

Australian privacy law does not necessarily require all information to be deleted immediately upon request, and Reality Fishing may need to retain some records for legal, accounting, fraud prevention, contractual, dispute resolution, competition administration or other legitimate purposes.

Where information is no longer required and there is no lawful reason to retain it, we will take reasonable steps to delete or de-identify it.

Deleting an account or requesting deletion of information may affect your ability to access membership benefits, giveaway entries, transaction history or other Reality Fishing services.

24. Anonymous and pseudonymous interactions

Where practicable, you may interact with Reality Fishing without identifying yourself, such as by browsing publicly available areas of our website.

Some services cannot reasonably be provided anonymously or using a pseudonym.

For example, we generally need identifying information to establish and manage a membership, process a transaction, administer giveaway entries, prevent duplicate or fraudulent accounts, confirm a winner’s eligibility, deliver a prize or provide personalised member benefits.

25. Children and young people

Reality Fishing services, memberships and promotions are subject to the eligibility requirements contained in the relevant membership terms, giveaway terms or other applicable conditions.

Where a particular service or promotion has a minimum age requirement, that requirement will be stated in the relevant terms.

We do not intentionally collect more personal information from children or young people than is reasonably necessary for the relevant service.

If Reality Fishing becomes aware that personal information has been collected from a person who is not eligible to use a particular service or participate in a promotion, we may take reasonable steps to delete, de-identify or otherwise appropriately handle that information.

If you believe Reality Fishing has collected information from a child or young person in circumstances where it should not have done so, please contact us.

26. Automated systems and decision-making

Reality Fishing may use software and automated processes for routine platform functions. These may include calculating membership benefits or giveaway entries, attributing referrals, applying eligibility rules, detecting unusual or potentially fraudulent activity, analysing platform activity and segmenting communications.

Reality Fishing does not currently intend to rely solely on automated systems to make decisions that could reasonably be expected to significantly affect an individual’s rights or interests without appropriate oversight.

If our use of automated decision-making changes materially, we will update this Privacy Policy and provide additional information where required by law.

27. Fraud, security and misuse

We may use personal information and technical information to protect Reality Fishing, members, partners and our systems.

This may include detecting duplicate or fraudulent accounts, manipulation of giveaway entries, unauthorised use of membership benefits or discount codes, suspicious transactions, attempts to compromise accounts and breaches of our terms.

Where appropriate, we may restrict or suspend access while suspected misuse is investigated.

28. Legal requirements

Reality Fishing may collect, use, retain or disclose personal information where required or authorised by Australian law, a court or tribunal order, regulatory requirements or other lawful authority.

We may also retain information where reasonably necessary in relation to actual or anticipated legal proceedings, disputes, investigations or enforcement of our contractual rights.

29. Privacy complaints

If you believe Reality Fishing has not handled your personal information appropriately, please contact us using the details below.

Please provide sufficient information for us to understand and investigate your concern.

We will review privacy complaints in a fair and reasonable manner and will generally aim to respond within 30 days, although more complex matters may take longer.

If you are not satisfied with our response and the Privacy Act applies to the matter, you may be able to make a complaint to the Office of the Australian Information Commissioner (OAIC).

30. Changes to this Privacy Policy

Reality Fishing may update this Privacy Policy from time to time to reflect changes to our services, technology, partners, information-handling practices or legal obligations.

The latest version will be published on our website and will show the date it was last updated.

Where a change materially affects how we handle personal information, we may take additional reasonable steps to bring the change to the attention of affected users.
