1. About these Terms

These Website & Platform Terms of Use (Terms) govern access to and use of the Reality Fishing Platform operated by Reality Fishing Pty Ltd (ACN 696 402 963; ABN 83 696 402 963), trading as Reality Fishing and Reality Club (Reality Fishing, we, us or our).

The Platform includes realityfishing.com.au and any Reality Fishing-controlled member dashboard, Deal pages, Giveaway pages, forms, portals, applications or other digital interfaces that expressly incorporate these Terms. It does not include an independent website or service merely because the Platform links to it.

These Terms are intended to protect the Platform, its users and Reality Fishing while preserving all rights and remedies that cannot lawfully be excluded.

2. Definitions

In these Terms, unless the context requires otherwise:

  • Account: a Reality Fishing user or membership account.
  • Commercial Partner or Partner: an independent business that provides a Deal, prize, product, service, experience or other benefit connected with Reality Fishing.
  • Deal: a Partner Discount, Exclusive Deal, member benefit, special offer, access entitlement or other commercial benefit presented through the Platform.
  • Member: a person holding a valid Reality Fishing membership, including Free, Core, Premium, Elite or any future membership tier.
  • Platform: the Reality Fishing-controlled websites and digital services described in section 1.
  • Promotion: a Giveaway, trade promotion, competition, prize campaign or other promotional activity conducted or facilitated by Reality Fishing.
  • Specific Terms: terms that apply to a particular membership, Deal, Promotion, purchase, booking, feature or other activity.
  • User Content: content supplied by a user through a feature intended to receive content, including comments, reviews, photographs, videos, submissions or public community material.

3. Scope and relationship with other terms

These Terms govern general use of the Platform. They do not replace Specific Terms that apply to a particular service or transaction.

In particular:

  • Membership registration, billing, renewal, tier benefits and Account deletion are governed by the Membership Terms & Conditions.
  • Member Deals are governed by the Member Deals Terms & Conditions together with the conditions displayed for the particular Deal.
  • Each Promotion is governed by its applicable Promotion terms and, where used, its Giveaway Schedule.
  • Personal information is handled under the Privacy Policy and applicable Privacy Collection Notices.
  • A purchase or booking made directly with a Commercial Partner may also be governed by that Partner’s lawful customer terms.

If these Terms are inconsistent with Specific Terms, the Specific Terms prevail to the extent of the inconsistency for the particular subject matter. These Terms otherwise continue to apply.

4. Acceptance of these Terms

Where the Platform asks you to accept these Terms through a checkbox, button, registration process or other electronic method, you agree to them by completing that process.

If you access or use public areas of the Platform after these Terms have been made reasonably available to you, your use is subject to these Terms to the extent permitted by law. If you do not agree, you should not use features that require acceptance and may stop using the public Platform.

Acceptance of these Terms does not constitute consent to optional marketing, sensitive-information handling or any other matter for which separate consent is required by law.

5. Eligibility and users under 18

Public areas of the Platform may be viewed by people under 18. Membership and individual Platform features remain subject to the eligibility requirements in the applicable Specific Terms.

A person under 18 must not use a feature, enter a transaction or participate in an activity if they are not legally eligible to do so. Where parental or guardian involvement or consent is required for a contract, payment, prize, regulated activity or other feature, that requirement must be satisfied.

Age-restricted Deals, alcohol-related benefits, particular Promotions and regulated products or services remain unavailable to people who do not satisfy the applicable age or legal requirements.

6. Accounts and authentication

Some Platform features require an Account. You must provide information that is accurate to the extent reasonably necessary for the feature and keep relevant Account information current.

You are responsible for taking reasonable steps to keep your login credentials secure. Do not knowingly disclose a password or authentication credential in a way that enables unauthorised use of your Account.

If you suspect unauthorised access, contact Reality Fishing promptly. We may use reasonable verification steps before changing Account ownership information, restoring access, disclosing Account information or processing a sensitive Account request.

Account sharing, duplicate Accounts, transfer of membership access and other Account matters may also be restricted under the Membership Terms, Deal conditions or Promotion terms.

7. Permitted use

You may use the Platform for its intended personal or business-facing purposes, including browsing information, managing your Account, accessing membership features, viewing Deals, participating in eligible Promotions, contacting Reality Fishing and using other features made available to you.

Any permission to use the Platform is personal, limited, non-exclusive, non-transferable and revocable where reasonably necessary under these Terms. It does not transfer ownership of Platform intellectual property or grant access to restricted systems, source code, databases or administrative functionality.

8. Prohibited use

You must not use the Platform in a way that is unlawful, fraudulent, abusive, misleading or materially interferes with the Platform, another user or Reality Fishing. Without limiting that obligation, you must not:

  • attempt to gain unauthorised access to Accounts, servers, databases, administrative areas, source code, payment systems or other restricted systems;
  • introduce malware, malicious code or other material designed to damage, disrupt, monitor or obtain unauthorised access;
  • use bots, scripts, scraping, crawling, data-mining or automated tools to harvest restricted member information, Codes, referrals, entries or non-public Platform data, except where expressly authorised or where a right cannot lawfully be excluded;
  • circumvent or attempt to circumvent security, eligibility, rate-limiting, membership, payment, Code, referral, Deal or Promotion controls;
  • impersonate another person or business, falsely represent authority or create deceptive Accounts;
  • manipulate giveaway entries, referrals, Deal redemptions, trip records, membership status, pricing, attribution or other Platform records;
  • use the Platform to harass, threaten, defame or unlawfully discriminate against another person;
  • upload or transmit content that you know is unlawful, infringing, malicious or materially deceptive; or
  • use Reality Fishing branding or Platform content to imply an endorsement, partnership or authority that has not been granted.

Reasonable security research or activity expressly authorised by Reality Fishing is not prohibited merely because it tests a system. Contact us before conducting testing that could affect the Platform or user information.

9. Platform information and general content

Reality Fishing uses reasonable care in preparing information published on the Platform. However, general website content may change, become outdated or contain an error, particularly where it reproduces information supplied by a Commercial Partner or third party.

Information displayed on the Platform should be read together with any applicable date, disclaimer, Deal condition, Promotion term, booking term or other Specific Term. Where a material error is identified, Reality Fishing may correct the information and take reasonable steps to address users who relied on it.

Nothing in this section permits misleading or deceptive conduct or removes a remedy available under applicable law.

10. Fishing, boating and outdoor information

Fishing, boating, marine, travel and outdoor information on the Platform is general information unless Reality Fishing expressly identifies a service as professional advice or a specific supplied service.

Conditions, laws and risks can change. Before acting on general content, users should independently consider current weather, tides, marine warnings, local rules, licensing requirements, vessel and equipment suitability, personal capability and any professional or operator instructions relevant to the activity.

General content is not a substitute for emergency information, regulatory directions, qualified medical advice, vessel-master directions, safety briefings or professional advice appropriate to the circumstances. This section does not limit any duty or responsibility that Reality Fishing has where it separately supplies a service.

11. Memberships

Reality Fishing memberships are governed by the Membership Terms & Conditions and the Plan Summary presented for the relevant membership. These Terms do not alter membership prices, renewal rights, benefit allocations, account-deletion consequences or other membership-specific matters.

A person may browse public Platform content without being a Member unless a feature is expressly restricted to Members.

12. Member Deals and Partner offers

Deals shown on the Platform are subject to the Member Deals Terms & Conditions and the conditions displayed for the particular Deal. Eligibility can depend on membership tier, location, availability, dates, stock, capacity, age, licensing or other disclosed conditions.

Unless Reality Fishing is expressly identified as the supplier or merchant for a transaction, the relevant Commercial Partner is the supplier of the goods or services purchased or booked using a Deal. The Partner remains responsible for fulfilment and its obligations under applicable consumer law.

Displaying a Partner or Deal does not mean Reality Fishing guarantees the Partner’s business, solvency, future availability or every aspect of the Partner’s independently supplied goods or services.

13. Giveaways and Promotions

Giveaways and Promotions are governed by the Specific Terms published for the relevant Promotion. Those terms determine eligibility, entry allocation, entry cut-offs, draw method, prize, winner verification, account-deletion consequences, unclaimed prizes and other Promotion-specific matters.

General website statements do not override Specific Promotion Terms. No Platform display, membership, referral, Deal or entry guarantees that a person will win a prize.

Reality Fishing may be required to verify eligibility, maintain draw records, publish limited winner information, obtain regulatory approvals or take other steps required by applicable law or permit conditions.

14. Purchases, bookings and third-party transactions

The Platform may link or direct you to purchases, bookings or payment processes operated by Reality Fishing or by independent businesses. The identity of the supplier should be determined from the relevant checkout, booking page, Specific Terms or transaction information.

Where an independent Commercial Partner is the supplier, your transaction is with that Partner. Reality Fishing does not become the seller, booking provider or contracting supplier merely because the Platform introduced the Partner, displayed a Deal or provided a verification Code.

Where Reality Fishing is itself identified as the supplier or merchant, the transaction will be subject to the applicable Reality Fishing transaction terms and Australian Consumer Law.

15. Third-party websites and services

The Platform may contain links to websites, booking systems, stores, payment services, social media platforms and other services operated by third parties. A link does not make that external service part of the Reality Fishing Platform.

Third-party services may have their own terms, privacy notices, security practices and availability. Users should review those documents before providing information or entering a transaction.

Reality Fishing is not responsible for the independent operation of a third-party service merely because it is linked from the Platform. This does not limit Reality Fishing’s responsibility for information it chooses to disclose to a third party or for representations it independently makes.

16. User submissions and community content

If the Platform allows you to submit User Content, you must have the rights and permissions reasonably necessary to provide that content. You must not knowingly submit material that infringes another person’s intellectual property, privacy or other legal rights, or that is unlawful or malicious.

Where you submit content to a feature specifically designed for public or member-community display, you grant Reality Fishing a non-exclusive, royalty-free licence to host, reproduce, format and display that content only to the extent reasonably necessary to operate that feature and the Platform. This licence does not transfer ownership of your content.

Where content is submitted for a Promotion, testimonial, marketing campaign or other specific purpose, the applicable submission or Promotion terms govern any additional licence or publicity rights.

Reality Fishing may moderate, restrict or remove User Content where reasonably necessary because of legal risk, privacy, security, harassment, infringement, spam, safety, technical requirements or a material breach of these Terms. We do not guarantee that all User Content will be reviewed before publication.

17. Feedback, ideas and support communications

Support requests, bug reports, complaints and ordinary feedback are used to investigate issues, provide support and improve Reality Fishing. Providing ordinary private feedback does not by itself give Reality Fishing permission to publish your identity, message, photograph or testimonial in advertising.

If you voluntarily provide a non-confidential suggestion about Platform functionality, you acknowledge that Reality Fishing may independently develop or implement similar ideas and may use the suggestion to improve its services without an obligation to pay for the idea. This does not transfer ownership of separately protected creative content that you submit.

Personal information contained in feedback is handled under the Privacy Policy, including the disclosed use of third-party communication systems where applicable.

18. Intellectual property

Reality Fishing or its licensors own or control the intellectual property rights in the Platform and Reality Fishing-created content, including branding, software, layout, text, graphics, photographs, videos, databases and other materials, except for material owned by Commercial Partners, users or other third parties.

You may view and use Platform content for the intended personal use of the Platform. Unless otherwise permitted by law or expressly authorised in writing, you must not reproduce, republish, commercially exploit, modify, distribute, sell, licence, reverse engineer or create a competing database from protected Platform material.

Nothing in these Terms restricts a statutory exception or other right that cannot lawfully be excluded.

19. Reality Fishing and Partner brands

Reality Fishing, Reality Club and associated names, logos and branding are Reality Fishing assets or used with permission. Commercial Partner names, logos and product branding remain the property of their respective owners.

You must not use a name, logo or other brand asset in a way that falsely suggests sponsorship, endorsement, agency or an official commercial relationship. Ordinary non-misleading references, lawful commentary and use permitted by law are not prohibited.

20. Linking and sharing

You may share links to publicly available Reality Fishing pages using ordinary linking or the Platform’s intended sharing features, provided you do not misrepresent the linked content, bypass access controls or imply an endorsement that does not exist.

Reality Fishing may require removal of a link or framing arrangement that materially misrepresents the Platform, creates a security concern, infringes rights or falsely suggests an authorised relationship.

21. Privacy, cookies, analytics and tracking

Reality Fishing handles personal information in accordance with its Privacy Policy and applicable Privacy Collection Notices. Those documents explain collection through Accounts, payments, Deals, referrals, Promotions, feedback, technical logs, UTM attribution, cookies, Google Analytics and other tracking or service technologies.

These Terms do not replace the Privacy Policy and do not treat use of the Platform as blanket consent to information handling that requires separate consent.

22. Electronic communications

Reality Fishing may send communications reasonably necessary to operate the Platform, an Account, membership, payment, Deal, Promotion, security process or support request. These service communications are different from optional marketing communications.

Marketing email, SMS or other commercial electronic messages are sent only where permitted by applicable law. Available unsubscribe methods and Account marketing preferences may be used to opt out of marketing without deleting an Account.

Where a notice or acceptance is validly given electronically under these Terms or Specific Terms, electronic records may be retained as evidence of the communication or agreement.

23. Security and unauthorised access

Reality Fishing takes reasonable steps appropriate to the Platform to protect systems and personal information. No internet or cloud service can be guaranteed to be completely secure.

You must not knowingly assist unauthorised access or disclose restricted Codes, credentials or security information contrary to the applicable conditions. If you identify a security issue, report it to Reality Fishing and avoid exploiting, publishing or escalating the issue in a way that creates unnecessary harm.

Reality Fishing may temporarily restrict access or invalidate compromised credentials or Codes where reasonably necessary to contain a security incident, investigate misuse or protect users.

24. Platform availability, maintenance and changes

Reality Fishing aims to provide a reliable Platform but does not guarantee uninterrupted, error-free or continuously available access. Maintenance, upgrades, internet failures, hosting outages, payment-provider issues, security incidents and other technical events may temporarily affect access.

Reality Fishing may develop, redesign, replace or discontinue Platform features. A change to general website functionality does not by itself alter an existing paid membership, confirmed Deal entitlement or Promotion right where separate terms or law protect that entitlement.

Where reasonably practicable, Reality Fishing will take steps to minimise disruption to time-sensitive functions such as payments, entries or active Deal access.

25. Errors and corrections

Reality Fishing may correct typographical, technical, calculation, configuration or publication errors. A correction will be handled consistently with applicable law and any Specific Terms governing the affected membership, Deal, Promotion or transaction.

If a material error may have affected a payment, entry, Code, eligibility determination or other user right, Reality Fishing may investigate the underlying records and provide an appropriate correction or remedy. An error does not give Reality Fishing an unrestricted right to cancel a confirmed transaction or remove a statutory right.

26. Suspension, restriction and protective action

Reality Fishing may temporarily restrict Platform access, an Account or a particular feature where reasonably necessary to address credible fraud, unauthorised access, security risk, system abuse, unlawful activity, serious harassment, manipulation of entries or referrals, or another material breach of these Terms or Specific Terms.

Protective action should be proportionate to the issue. Where reasonably practicable and lawful, Reality Fishing will explain the reason and provide an opportunity to respond or remedy the issue before permanent Account closure or material loss of a paid benefit.

A genuine complaint, privacy request, refund request, charge enquiry or lawful criticism is not by itself prohibited conduct.

27. Australian Consumer Law and statutory rights

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or other protection that cannot lawfully be excluded under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or under other applicable law.

Where Reality Fishing supplies goods or services to a consumer, statutory guarantees and remedies apply as required by law. A disclaimer elsewhere on the Platform does not remove those rights.

These Terms are intended to operate fairly and transparently. If a provision would be unlawful or unfair in a way that makes it unenforceable, it will operate only to the extent permitted by law.

28. Responsibility and liability

Reality Fishing remains responsible for its own acts, omissions, Platform services and representations to the extent required by law. Commercial Partners and other independent suppliers remain responsible for their own goods, services, bookings, transactions and conduct.

To the maximum extent permitted by law, Reality Fishing is not responsible for loss to the extent it was caused by a user’s unlawful or negligent misuse of the Platform, unauthorised sharing of credentials, failure to follow clearly disclosed requirements, or the independent act or omission of a third party outside Reality Fishing’s control.

Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, personal injury or other liability to the extent it cannot lawfully be excluded or limited. These Terms do not impose a blanket or unlimited indemnity on users.

Where loss is caused by more than one person, responsibility is to be allocated according to the circumstances and applicable law.

29. Events outside reasonable control

Reality Fishing is not responsible for delay or temporary failure caused by circumstances genuinely outside its reasonable control, including significant telecommunications failure, widespread technology outage, natural disaster, government action, industrial disruption, fire, flood or comparable events.

Reality Fishing will take reasonable steps to reduce the impact where practicable. This section does not override non-excludable consumer rights or Specific Terms dealing with an affected Promotion, Deal, membership or transaction.

30. Complaints and disputes

For Platform, Account, membership, Deal or Promotion administration issues, contact Reality Fishing using the details in section 34. Please provide enough information to identify the relevant Account, page, transaction, Deal or Promotion, but do not send passwords or complete payment-card details through ordinary email or feedback forms.

Reality Fishing will review complaints fairly and within a reasonable period. A user is not required to give up any right to contact a consumer regulator, privacy regulator, court or tribunal with lawful jurisdiction.

Where a complaint relates primarily to goods or services supplied by a Commercial Partner, Reality Fishing may direct or refer the matter to that Partner while remaining responsible for any issue within Reality Fishing’s own control.

31. Changes to these Terms

Reality Fishing may update these Terms from time to time to reflect changes to the Platform, law, security requirements, business operations or available features. The current version will be published on the Platform with its effective or last-updated date.

Changes apply prospectively to Platform use after they take effect, subject to applicable law. A change to these general Terms does not by itself retrospectively remove an accrued right under a paid membership, completed transaction, valid Deal or Promotion where separate terms or law protect that right.

Where a material change requires specific notice or consent under applicable law or an existing agreement, Reality Fishing will provide that notice or obtain that consent as required.

32. Governing law and jurisdiction

These Terms are governed by the laws in force in Queensland, Australia, together with applicable Commonwealth laws of Australia, subject to any mandatory law that applies because of where you live, where a transaction occurs or where a Promotion is conducted.

Nothing in these Terms requires a consumer to give up a court, tribunal, regulator or other forum available under mandatory law.

33. General provisions

If a provision of these Terms is invalid or unenforceable, it is to be read down to the minimum extent necessary to make it valid and enforceable. If it cannot reasonably be read down, it may be severed without affecting the remaining provisions.

A failure or delay by Reality Fishing to enforce a provision does not waive that provision. A waiver is effective only to the extent expressly given.

These Terms do not create an employment, partnership, joint venture, fiduciary or general agency relationship between Reality Fishing and a user.

Headings and summaries are for convenience and do not limit the meaning of the operative provisions.

These Terms, together with the Specific Terms applicable to a particular feature or transaction, form the agreement concerning the Platform matters they cover.
